Introduction

This Personal Online Banking Agreement and Disclosure governs your use of Online Banking. Throughout this website, the Agreement and Disclosure will be referred to as “Agreement.” By using Online Banking, you agree to all of the terms of this Agreement. Please read it carefully and keep a copy for your records. Online Banking consists of a series of components that make up a complete online website that provides a full array of financial services to our customers. By agreeing to these terms, you certify (1) that you have read and agreed to all terms, authorizations, and disclosures received at the time the account was opened and any subsequent disclosures since that date, and (2) that you are an owner/signer on all accounts that you are accessing through Online Banking.

Definitions

“You or Your” – The person(s) subscribing to or using Online Banking. “We, Us, or Our” – Refers to TABADUL and any agent, independent contractor, designee, or assignee TABADUL may involve in the providing of Online Banking. “Business Day” – Any calendar day other than Saturday, Sunday, or any holidays as established by The Federal Reserve Bank. “Services” – Online Banking. If you have any questions or concerns about these Terms & Conditions or our practices with regard to your personal information, please contact us. Please read the following Terms & Conditions carefully. By using this Website, you acknowledge that you have read the following Terms & Conditions and agree to be bound by them as may be amended by Tabadul, from time to time, and posted on this Website. If you do not agree to these Terms of Use do not use the Website.

Virus Protection

TABADUL is not responsible for any electronic viruses that you may encounter. We encourage each customer to routinely scan their computer system using a reliable virus product to detect and remove any viruses. Undetected or unrepaired viruses may corrupt and destroy applications, files and even your hard drive. Additionally, you may unintentionally transmit the virus to other computers

Log-on and Security

The safety of our customers’ accounts and account information is of paramount importance to TABADUL. We go to great lengths to protect confidentiality in order to ensure the security of your accounts. You agree not to allow anyone to gain access to the Services or to let anyone know your Password used with the Services. You agree to assume responsibility for all transactions initiated through the Services with your Access ID, up to the limits allowed by applicable law. While TABADUL continues to provide our customers with the level of online security, we believe necessary and appropriate, customers who share their Access ID s and Passwords are giving up the full benefit of our security measures and legal protections to which they may be entitled. Because your Password is used to access your account, you should treat it as you would any other sensitive personal data. You should carefully select a Password that is hard to guess. (We suggest that you stay away from names, dates, and any other information that may easily be guessed). Keep your Password safe. Memorize your Password and keep it confidential. Change your Password frequently. This can be changed during any Online Banking session. No TABADUL representative will ever call and ask for your Password. If your online banking credentials have been compromised, call TABADUL immediately at +9647833333311, during any time of the day. Telephoning is the best way of minimizing your losses. You may also restore the security of your Service by immediately changing your Password.

Fees

There is no charge for downloading Personal Online Banking.

Limits

To use the digital banking service, daily and monthly payment limits for payment transactions in national, international and crossborder payments are applied. Information on the amount of daily and monthly limits are available in the website and mobile application. Banking and Internet Banking Services. The User may increase/decrease limits within the default value assigned by the Bank either via branch or via the digital banking service. The daily and / or monthly limit specified at the User's request is applied immediately. When using the Daily and Monthly Service, payment transactions for foreign currency transactions are reduced to foreign currency equivalent, according to the buy exchange rate of the Bank. The Bank determines which types of transactions do not affect the reduction of daily and monthly limits, namely: Normal Document o Transfer to myself (transfers between customer’s own accounts) o Currency conversion (transfers between customer’s own accounts in other currency) o Domestic Transfer o Direct debits (customer can set their own limit during the time of direct debit setup) o Other transactions as may be enriched from time to time 11. Execution of Payment Transactions Tabadul through the Services enables the User to execute domestic and cross-border payment transactions when enabled. Payment orders authorized by the Service are executed in accordance with the information published in the Terms and Conditions. Depending on the type of authentication system and authorization used by the User, the consent to execute a payment transaction is provided by the User through authentication / authorization systems in accordance with the methods described in this document. The Bank allows the User through the service to activate the so-called Fast Transfers procedure. Once the User independently or via ISBA’s Internet Banking Application Services chooses and authorizes the use of this functionality through the authentication / authorization system that he / she uses, when initiating payment orders, the system will not require the individual authorization of the order from the User. The user independently through the digital service may deactivate this functionality. The Bank allows the Customer through the Service to determine the so-called trusted account, for which the system will not require the execution of authorization procedure. A trusted account can be any account in favor of which the User decides to initiate payment orders without undergoing the authorization process. The Customer may deactivate this functionality through the Digital Service. The Bank allows the Customer to activate through the Service the #withPAY payment functionality. The Bank will send to the Customer the statement of account/s and or other banking products which the Customer has with the Bank only through the digital banking platform whenever this option is enabled. Other alternative means of receiving the bank statements may be configured from the Customer himself in the digital banking service. 12. Operating hours of the Digital Service The systems are available 24 hours a day except for the periodical closing and system maintenance periods. The bank shall inform the Customer about maintenance times accordingly. During the regular maintenance of the Service, the User will be partially or completely disabled in using the Service. Regular Maintenance Services are performed at a time when, according to the Bank's estimate, is the lowest frequency of use of the Service. The transaction timelines are as defined in the Bank’s Terms and Conditions. In the event of technical breakdown or malfunctions.

Use of Information and Materials

The information and materials contained in these pages, and the terms, conditions, and descriptions that appear, are subject to change. Unauthorized use of Tabadul’s websites and systems, including but not limited to unauthorized entry into Tabadul’s systems, misuse of any password, user ID, e-mail address or misuse of any information posted on a site, is strictly prohibited. Balance Inquiries and Transfers

You may use Online Banking to check the balance of your accounts, to transfer funds among enrolled accounts, and to initiate bill payments. Services are generally available 24 hours a day, 7 days a week, except during special maintenance and upgrade periods. Shown balances of your accounts may include deposits subject to verification by us. The balance may also differ from your records due to deposits in progress, outstanding checks or other withdrawals, payments or charges. No Signature Requirements

When any payment or other online service generates instructions or items to be charged to your account, you agree that we may act on such instructions, debit the designated account or the account on which the item is drawn without requiring your signature on the item and without any notice to you.

Links and Third Party Product and Service Providers

TABADUL HEREBY DISCLAIMS LIABILITY FOR ANY INFORMATION, MATERIALS, PRODUCTS OR SERVICES POSTED OR OFFERED AT ANY OF THE THIRD-PARTY SITES LINKED TO THIS WEBSITE. BY CREATING A LINK TO A THIRD PARTY WEBSITE, TABADUL DOES NOT ENDORSE OR RECOMMEND ANY PRODUCTS OR SERVICES OFFERED OR INFORMATION CONTAINED AT THAT WEBSITE, NOR IS TABADUL LIABLE FOR ANY FAILURE OF PRODUCTS OR SERVICES OFFERED OR ADVERTISED AT THOSE SITES. TABADUL may use Google Analytics or Google Ads to gather basic information about website visitor behavior, interests, website performance, and other general data about our website and its use. Advertising

TABADUL may use pixel or cookie technologies to market to website visitors. However, most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. Making Sure Information is Accurate

Keeping your account information accurate and up to date is very important. If your account information is incomplete, inaccurate or not current, please call or write to us at the telephone numbers or appropriate address for such changes listed on your account statements, bank records, online banking or other account materials.

Looking out for Children

We do not knowingly market to or solicit information from children under 18 without parental consent. We recognize that protecting children’s identities and privacy online is important, and that the responsibility to do so rests with both the online industry and with parents. While TABADUL works to protect your personal information as a financial institution, you also have responsibility. The internet is a public network. Childrens’ access to the internet can allow them to visit inappropriate websites and be exposed to unwanted risks. COPPA, the Children’s Online Privacy Protection Act, protects children under the age of 13 from online collection of personal information. Parents can be proactive by installing filtering software that gives them more control over their family’s internet experience. We recommend that minors 18 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet. Additionally, we do not target or re-market to anyone under the age of 18 through preventative measures put in place by third-party social media and advertising partners such as Google and Facebook.

USER DATA

Electronic Mail (e-Mail)

If you send TABADUL an electronic mail message through the Service, TABADUL will be deemed to have received it on the following Business Day. E-mails will be answered within a reasonable timeframe. You should not rely on electronic mail if you need to communicate with TABADUL immediately (e.g., if you need to report an unauthorized transaction from one of your accounts or if you need to stop a payment that is scheduled to occur).

Alerts/Messages

Online Banking alerts allow you to set up automated alert events based on your own. Alerts may be sent by email or in an online message box within Internet banking, or both. E-mail alerts will be sent to the e-mail address you provide when creating the alert. • TABADUL may add or remove types of alerts from time to time. • If you change your e-mail address, you are responsible for changing this in the alerts you have already set up. • You agree that alerts may be delayed or prevented for a variety of reasons. • We do not guarantee the delivery or validity of the contents of any alert. • You agree that we shall not be liable for any delays, delivery failure or misdirected deliveryof any alert. • You agree that we shall not be liable for any actions taken or not taken by you or anyone else in reliance on an alert. • TABADUL will never include your password or full account number in an e-mail alert; however you understand that alerts may include your name and some information about your accounts. • Unfulfilled events (events that do not happen) will only remain on the system for 999 days. You will not be notified when they are removed. • Distributed events (events that have happened and have been viewed) will remain on the system for 30 days.

Amendments

Terms and conditions of this Agreement may be amended in whole or in part at any time. TABADUL will notify you at least 21 days if the change would result in (i) increased fees; (ii) increased liability; (iii) fewer types of available electronic fund transfers; or (iv) stricter limitations on the frequency or dollar amount of transfers. TABADUL will not give prior notice if an immediate change in terms or conditions is necessary to maintain or restore the security of an account or an electronic fund transfer system. If TABADUL makes such a change permanent and disclosure would not jeopardize the security of the account or system, we will notify you in writing or with next regularly scheduled periodic statement or within thirty (30) days of making the change permanent. If you do not agree with the change(s), you must notify us in writing prior to the effective date to cancel your access. Amendments or changes to terms and conditions may be made without prior notice if it does not result in higher fees, more restrictive service use, or increased liability to you.

Termination

You may terminate the use of Online Banking at any time by contacting TABADUL in writing, by telephone, in person at your local branch, or by mail to the same address listed below. If the account is closed or restricted for any reason, Online Banking accessibility to that account will automatically terminate. We may terminate your use of Online Banking at any time.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Iraq.

Assignment

You may not assign this Agreement to any other party. We may assign or delegate, in part or whole, to any third party.

Other provisions
